Community behavior that deviates from the norm will usually cause a problem in the field of law and will harm other communities. Crime is a form of deviant behavior that is always inherent in society. Criminal law in Indonesia is one of the most important guidelines in realizing justice. Every act of someone who violates, acts of obeying orders and prohibitions in criminal law is called a criminal act. One form of crime that often occurs around the community is crime in the form of violence such as persecution. The existence of criminal acts of persecution that can occur because it cannot be separated from the behavior of the community which is less controlled either due to the low level of education and the influence of a bad social environment. Disputes both personally and in groups can be a factor that can invite acts of violence that lead to persecution. One of the criminal acts of persecution that resulted in serious injury, namely in Decision Number: 519/Pid.B/2021/PN.Gns.The problem in this writing is why the perpetrator committed the crime of persecution which caused serious injury and how to implement criminal sanctions against the perpetrators of the crime of persecution which caused serious injury in Decision Number: 519/Pid.B/2021/PN.Gns.This research uses a normative and empirical juridical approach. Sources of data in this study using secondary data and primary data. Data collection in this study was carried out by collecting information directly through library research, observation and interviews.The factor that caused the perpetrator to commit the crime of persecution which caused serious injury in Decision Number: 519/Pid.B/2021/PN.Gns was due to a misunderstanding between the Defendant and the victim. The defendant was provoked by his emotions towards the victim due to a miscommunication and mcaused the Defendant to feel emotional so he committed the act of maltreatment which caused serious injury to the victim. The maltreatment that was committed by the Defendant against the victim was carried out by using an iron axle of a car which was struck towards the back and head of the victim causing the victim to suffer injuries to the victim's back and head. Implementation of criminal sanctions against the perpetrators of the crime of persecution that caused serious injury in Decision Number: 519/Pid.B/2021/PN.Gns by imposing prison sentences on the Defendant. The judge in giving his decision by looking at the evidence presented at the trial, namely witness statements, evidence, instructions and the defendant's own statement. Apart from that, the elements of Article 351 paragraph 2 of the Criminal Code that were charged against the Defendant have been fulfilled and during the trial process the Panel of Judges did not find circumstances with excuses and reasons justifying the actions committed by the Defendant. So that the Panel of Judges believes that the Defendant has been proven legally and convincingly guilty of committing the crime of persecution which caused serious injury by imposing a sentence on the Defendant with imprisonment for 6 (six) months. It is suggested that the community is expected to be able to maintain harmony and establish good relations with other members of the community, so that conflicts can be avoided which could have been the cause of criminal acts of violence such as persecution. In addition, people must think healthily and always prioritize communication so that misunderstandings with other people do not occur so that it is not easy to be provoked by emotions that can lead to criminal acts.
